Divorce Rules in Islam

Ruling on divorce by telephone, internet and text message

If a man divorces his wife three times by telephone or through WhatsApp and Messenger etc., it becomes a divorce.

Similarly, if a man sends a message to his wife and writes three divorces in the message, then this message will also divorce his wife.  Whether the message has reached the wife or not, the wife has read or not read.  In any case, there will be a divorce. Because divorcing your wife in writing leads to divorce, and in this writing stamp paper, plain paper, messages and WhatsApp are all equal.  So if three divorces are given in the message, all three will happen.  And she will not be allowed to keep him as a wife. Yes, if he divorces his wife, he can call her again and say that you are my wife.

In that case, he can make her his wife again.  This is called "recourse" in the Shari'ah. If he touches his wife or has sex with her, he will still return. After recourse, the husband will have the option of only two divorces.  That is, if after that the husband divorces his wife twice, then the husband cannot live with his wife, and that wife will be haraam for him.

Similarly, if the husband has given two divorces over the phone or text message, he can still seek recourse and after recourse, the option of one divorce will remain. At the same time, remember that this recourse should take place between 'iddah.  A woman's' iddah is three menstrual periods. If a woman's' iddah has passed, then he will have to remarry his wife.

It should be noted that although giving three or more divorces together is a sin according to Shari'a and the government should make a penal law in this regard, all three divorces take place in the light of the Qur'an and Hadith and the decisions of the Companions.

Fatwas of India - (1/2)

The book is in the form of a book, which is a source of information, but it is not the same as the book of the day. The book

Ibn al-Najim (may God have mercy on him) said: And the first thing is clear, and the first thing is that you return, and if you are present, you will return, and you will return.  If you are with me as you are, or if you are immortal, then stop for the purpose)  Al-Bahr al-Ra'iq: 4/54).

And if a man divorces his wife, then he will return to her, so that he may return to her.  It is based on two thirds in the number and after the consensus, and other prohibitions in which there is no similarity.
